TERMS OF SERVICE

Welcome to Higher Conscious Network (“HCN,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our parent business operations, websites, decentralized paid platform, WebXR/5D multi-dimensional environments, internal AI modules, and focus groups.

By accessing our network, authenticating via a cryptographic wallet, or completing a fiat purchase, you agree to be bound by these Terms. If you do not agree, you are prohibited from using our services.

1. Platform Infrastructure & Decentralized Authentication

HCN operates a decentralized environment merging traditional web architecture with public blockchain networks:

• Cryptographic Access: Users authenticate and log in using Web3 cryptographic signatures and Decentralized Identifiers (DIDs).

• Self-Custody Responsibility: You are solely responsible for securing your private cryptographic keys, digital wallet hardware, and access phrases. HCN does not have custody of your private keys, cannot recover lost wallets, and cannot reverse on-chain transactions.

• Internal AI Services: Content and course optimizations are assisted by our proprietary internal AI. AI assets are explicitly marked within the user interface.

2. Commercial Terms, Billing, & Stripe Integration

HCN offers paid platform tiers, including exclusive courses, focus group participation pathways, and live WebXR/5D immersive sessions.

• Fiat Payment Processing: Traditional credit, debit, and subscription payments are processed securely via our Stripe integration. By submitting payment information, you agree to Stripe's legal terms and processing frameworks.

• Subscription Architecture: Paid tiers billed via Stripe operate on a recurring billing cycle. You authorize automated charging of your designated payment method until you cancel through your account settings or user dashboard.

• On-Chain Transactions: For access options validated via stablecoin or cryptographic native assets, payments are completed via peer-to-peer smart contract interactions. You bear all blockchain network gas fees associated with your transactions.

• Refund Policy: Due to the immutability of public blockchain networks and the immediate delivery of digital assets, all crypto-fiat hybrid or on-chain payments are strictly non-refundable. Stripe-processed transactions may be subject to localized consumer defense regulations, and refund inquiries must be submitted directly to billing support.

3. Institutional, Corporate, & Government Procurement

These standard online Terms govern individual consumer and individual participant accounts only.

• Contractual Access Mandatory: Universities, healthcare organizations, corporate entities, research departments, and government bodies are prohibited from using individual tier licenses for organizational deployment.

• Dedicated Enterprise Intake: All institutional, B2B, or state-affiliated procurement must be executed via an independent, custom Service Level Agreement (SLA). Organizations must direct all contractual inquiries, API use-case requests, or specialized auditing demands to: guidance@higherconscious.network.

4. Acceptable Use & Immersive Environment Boundaries

When interacting with our community postings, live sessions, or WebXR/5D multi-dimensional spaces, you agree not to:

• Decompile, reverse-engineer, or attempt to isolate the training weights or architecture of HCN's proprietary internal AI.

• Use any software vulnerability or smart contract exploit to bypass payment check-gates, subscription tiers, or wallet-signature validation.

• Deploy external scraping software, spiders, or automated scripts to capture educational material, focus group inputs, or platform media.

• Disrupt real-time WebXR sessions through spamming, spatial tracking manipulation, or harassing behavior that threatens the mental or psychological safety of the collective space.

5. Educational and Wellness Disclaimer

• No Professional Advice: All materials, interactive courses, data processing outputs from our internal AI, and 5D mental wellness sessions are designed exclusively for informational and educational purposes.

• Clinical Exclusion: HCN content does not constitute medical, psychiatric, clinical, financial, or legal advice. Platform engagement must not replace traditional consultation with licensed medical or health professionals.

6. Intellectual Property & Algorithmic Ownership

• Proprietary Rights: All structural software design, code, interface layouts, proprietary fonts, instructional frameworks, media assets, and our developing mental wellness algorithm remain the exclusive property of Higher Conscious Network.

• User-Generated Submissions: By posting content, entering text prompts into the internal AI, or submitting feedback in an active focus group, you grant HCN a non-exclusive, global, royalty-free license to use, synthesize, and adapt that content purely to expand our internal educational structures and refine our wellness algorithms, subject to the explicit "Opt-In" settings defined in our Privacy Policy.

7. Global Limitation of Liability & Cross-Border Compliance

• As-Is Delivery: HCN services are delivered on an "As-Is" and "As-Available" basis without warranties of any kind, explicit or implied.

• Blockchain Faults: HCN is not liable for financial loss, network downtime, or data corruption originating from layer-1 or layer-2 public blockchain disruptions, wallet software failure, or malicious third-party hacks targeting your self-custodied keys.

• Jurisdictional Compliance: HCN functions as a global enterprise. If you access our platform from regions governing high-risk AI deployment (such as the EU under the EU AI Act) or strict data boundary regulations, you are responsible for ensuring your local usage parameters comply with national laws.

8. Amendments & System Notifications

HCN reserves the right to modify these Terms as our global network expands. Any material operational changes—including additional Stripe pricing tables or alternative blockchain network support—will be announced on our primary domains with a revised effective date. Your continued cryptographic authentication or fiat transaction confirmation following an update establishes your binding acceptance of the revised Terms.
